Delaware law permits access to adoption records by court order only. In cases in which the adoptee's health or the health of a blood relative of the adoptee is concerned, if the agency has refused to release health information to the individual the Court may, on petition, permit that person to inspect that part of the agency or court record containing medical information for health reasons. Identifying information may be disclosed if blood relative are necessary to medical treatment.

UPDATE: Jan 1995. Delaware Code, Title 13 Chapter 9 Sub-Chapter 3 An adult adoptee or birth parent can file an affidavit consent to release identifying information in the Family Court of the county where the adoption or relinquishment took place.

If the person sought does not have an affidavit on file, the court will order a search through a private agency to seek consent. Fees are on a sliding, income based scale. If the other party is not located or does not consent, information will not be released.

If a birthparent is deceased, the adoptee can ask the court for the original birth certificate.
